Well, if it is clearly stated in the handbook or on paperwork you and your parents had to sign then they have every right to take it away because they told you before hand what would happen and if not then they most likely have a very reasonable explanation.........

They aren't keeping it. That's called theft, then you are legally able to call police and have them arrested. I think you can last a day without a phone.
